Documented Actions:

  • Lied about the child being temporarily gone with the mother to cover for a concealed, permanent custody transfer.
  • Moved my son’s clothes into her personal room and withheld them to assert control.
  • Interfered with father-son discipline and parenting:
    • Undermined accountability and consistency,
    • Attempted to stop the father from taking his son out in public or to work,
    • Sabotaged everyday parenting routines and boundaries.
  • Pretended ignorance of Anngeneth’s adultery and maternal abandonment while knowingly assisting it.
  • Allowed Anngeneth to leave the child behind so she could go out and “play” or stay with her boyfriend.
  • Provided misleading or false information to Barangay and Police.
  • Attempted to withhold the child’s birth and marriage certificates during documentation efforts.
  • Stole ₱3,000 during a relocation and got caught. Said she only borrowed.
  • Actively supported the child’s concealment and blocked rightful paternal custody.
  • When fixing her front gate with new weld repairs, hidden agendas were in the works to take my son.

Legal Violations:

Revised Penal Code, Article 267 – Kidnapping and Serious Illegal Detention
Any private individual who detains or conceals another without authority violates this article. Concealing a minor from a custodial parent is covered.

Revised Penal Code, Article 270 – Kidnapping and Failure to Return a Minor
Applies to any person who is entrusted with temporary custody and refuses to restore the child to the rightful parent.

Family Code, Article 211 – Joint Parental Authority
Only the court may override joint parental rights. Lina had no legal standing to interfere or act unilaterally. Interference with parental authority is illegal unless ordered by a court. Her meddling in discipline, movements, and daily decisions was unlawful.

Presidential Decree 1829 – Obstruction of Justice
Willfully giving false statements or assisting in illegal concealment of a child obstructs lawful investigation and custody rights.

Civil Code, Articles 19–21 – Abuse of Rights
Any person must act with fairness and good faith. Lina enabled a custody crime while hiding behind false pretenses.
